会议分为三大讨论专题：治安顽症类犯罪的刑事政策、治安顽症具体犯罪的法律适用与综合治理及外来人员犯罪的刑罚适用与防治对策，分别由市高级人民法院研究室主任刘力、市高级人民法院刑一庭庭长周芝国及市法学会诉讼法研究会会长张海棠主持。本所主任李小华高级律师作为市法学会诉讼法研究会副会长，在法律实务方面具有20余年的工作积累，围绕治安顽症具体犯罪的法律适用与综合治理发表演讲。参加研讨的还有市区两级政法委、法院，公安、检察院的领导及市法学会、上海社科院法学研究所、华东政法大学、上海政法学院等高校和研究机构的专家教授。各界齐聚一堂，共商良策。

黄浦区社会工作委员会副书记洪峰传达了市“两新”组织党建工作会议的精神，李熊熊书记对2012年黄浦区“两新”组织党建工作的要点进行了工作部署。

在交流互动环节，本所党支部书记、主任李小华进行了汇报。李小华高级律师以《围绕中心建设，助推律所发展——以党建为引领争创更佳成绩》为题，立足本所特点，向大会汇报了律所服务中心工作、以党建助推律所发展，加强支部建设、提高党员素质，践行社会责任、奉献和谐社会等方面开展党建工作，发挥党支部的战斗堡垒作用与党员的先锋模范作用，增强党建工作有效性的主要做法与基本经验。恒源祥（集团）有限公司党委、安利（中国）日用品有限公司上海分公司党总支、豫园社区小商品市场党总支代表也分别进行了工作汇报。

方莉萍部长在总结发言时充分肯定了“两新”组织开展党建工作取得的成效，并对2012年党建工作提出了新的要求与期望。

本所将认真学习方部长讲话精神及各家交流单位的党建经验，继续围绕中心、服务大局，争创更佳的成绩。

刘小禾副秘书长在会上讲话时谈到，老龄工作是党和国家的一项重要工作，老年维权工作的意义重大。她表示，本次荣获表彰的9家律所和22位律师是上海1100多家律所、13000多名律师的优秀代表，他们所做出的成绩是上海律师发扬奉献精神，承担社会责任的具体表现，向整个社会展现了律师维护法律正确实施、维护社会公平正义、维护当事人合法权益的良好形象。

本所将珍惜荣誉，一如既往为维护老年人的合法权益献计献策、奉献爱心，为构建和谐社会做出应有的贡献。

会上，青浦区社会工作党委、徐汇区虹梅路社区综合党委、上海豫园社区小商品市场党总支以及上海五天实业有限公司党支部代表分别作了精彩的报告。施南昌书记对2011年上海市两新党建信息化工作做了总结并对2012年党建信息化工作的重点进行部署。

此次会议为上海市两新组织党建信息化工作明确了工作主线，总结了优秀支部网站在党建信息化工作中的经验，为今后两新组织党的建设明确了工作的方向和目标。通过这次会议，党支部将总结党建信息化工作取得成效的经验，进一步依托网络平台开展好党建工作，以崭新的成绩迎接党的十八大召开。

自创先争优活动开展以来，司法部、区委、区政府主要领导及分管领导多次来所调研指导工作，市委、区委组织部、市、区社工委、市、区司法局党委等领导对事务所党支部进行指导并保持着紧密联系，为事务所党支部发展把脉，使党支部始终朝着正确的方向发展，紧紧围绕中心、服务大局，律所经济效益与社会效益取得双丰收。

One night, when I sat alone in the office reading files, I received a phone call from a deputy director of a vacuum tube factory. His name is Tian Hao and was suspect of corruption. Now he was bailed out.

Tian Hao described to me the case detail: His company was planning a reformation, turning the vacumm tube factory from collective enterprises to stock cooperative enterprises. The plant manager decided to use the secret capital of 1.15 million yuan to reward leadership group members, each person getting 230,000 yuan. Some staffs in the factory were not satisfied with the decision and some even reported to prosecutors. The director, five leaders including Party branch secretary, deputy director, and financial division director were arrested on and bailed out for trial. It is held in the prosecution opinion that the criminal suspect Zhang, Mao, Tian and other 2 people, appointed by their superior, took advantage of his post and divided the secret fund 1.15 million as incentives, constituting crimes.

According to article 383 of the PRC Criminal Law, provided that the amount of personal corruption is 100,000 yuan or more, over 10 years term imprisonment or life imprisonment shall be imposed and also property confiscation is applied; provided the circumstances are especially serious, the death penalty and confiscation of property shall be applied.

After investigation, I exchanged views with the undertaking personnel. I put forward that Tian doesn’t meet the requirement of corruption–he is not national staff. The Prosecution accepted part of my view and held Tian has violated section 271 of the Criminal Law provisions, constituting duty encroachment.

The Court held a public hearing of the case, and made first-instance, giving 1 year and 6 months jail time and 2 years probation. Despite the first instance verdict reduced Tian’s punishment, it still confused crime and non-crime, making innocent people guity.

At the same time, Tian Hao was disheartened after the first instance, because the first instance verdict dismissed him and expelled him from the party, which means he can only rely on life subsidy. I explained to Tian Hao that if he can’t accept the verdict, he can bring appeal against the superior courts. And Tianhao hired me as his second trial counsel.

In the second instance, I held that: First, the appellant didn’t have the intension of joint occupation of corporate property; second, the appellant didn’t have the action of illegal occupation of corporate property. The Court gave the second instance verdict that the appellant Tian Hao was not guilty.

Lawyer Voice: only under the law principle, can we protect human rights awareness and can the legitimate rights and interests can be maintained.

I learn from the conversation that her husband Chen Hong has gift in design and now is a manager of a well-known state-owned company in Shanghai. However, not long after Chen took office, he was taken away by Anti-Corruption Bureau. It is said that Chen received bribes from two companies.

According to provisions of the Criminal Law, if the amount of bribes is over 100,000 yuan, the accused will be sentenced to more than 10 years imprisonment or even life imprisonment; if the circumstances are especially serious, the accused will be sentenced to death penalty.

After I accepted the commission, I went to the detention center to visit Chen. I found out an important detail that: Chen contributed 500,000 yuan anonymously, jointly investing with Mr. Shen. They undertook a decoration project of Cheng’s company and got 100,000 yuan. I asked Chen if he shared risks and benefits with Mr. Shen, he gave me an affirmative answer.

But how can I prove that Chen’s telling the truth? Later, I found Mr. Shen and confirmed the truth of Chen’s statement through conversation. Then I accompanied Shen to the notary office notarize his testimony.

Then, I took the notarial deed to the Procuratorate and exchanged views with the procurator. A few days later, when I arrived at the detention center again, Chen Hong told me that the Procuratorate has decided to bring a lawsuit for only 80,000 yuan bribery and confirmed that he had surrendered himself, which means that prosecutors accepted my defense.

In the trial, the prosecutor read out the indictment, and had a cross-examination. In the statement stage, Chen bowed to the court and expressed his regret because of his ignorance of law. Court decision: Chen was sentenced to 1 year and 6 months imprisonment, suspended for 2 years. After the verdict, Chen Hong reunited with his family. He thanked us again and again for helping him safeguard the legitimate rights and interests.

Lawyer voice: when I just accept the case, the prosecutor and I had tensions. In the prosecution phase, I presented my views to the prosecutor. In determination of the amount of money, the both parties have reached a consensus. So the lawyers have fulfilled his purpose and there is no need to argue in the court. I advocate that when lawyers handling criminal cases, he not only should analyze the existing material, but also explore in depth for all the materials relevant to the case, so as to make objective and fair defense.
