一、案情简介case introduction

原告方立平（男）与被告潘炜（女，澳大利亚籍）系夫妻关系。原告已夫妻感情已经破裂，故原告向法院提起离婚诉讼divorce proceedings。诉讼请求Lawsuit Request：

1、判令原、被告离婚Order the plaintiff and defendant to divorce；2、双方所生女儿随原告共同生活Daughter living with plaintiff，被告支付抚养费；3、离婚后双方自行解决居住；4、各自财产归各自所有。

被告潘炜委托上海李小华律师事务所指派的马德徽律师作为离婚诉讼代理人Lawyer Ma Dehui as a divorce litigation representative。

马律师提出代理意见Lawyer proposes representation opinion：

1、原被告感情确已破裂，应判决双方离婚Both parties should be sentenced for divorce；

2、女儿由被告及被告父母照料Daughter is taken care of by the defendant and the defendant's parents

根据最高人民法院关于适用《中华人民共和国民法典》婚姻家庭编的解释（一）第四十七条之规定，法院应判决应由被告抚养The court should rule that the defendant should continue to be raised。
